By accessing, browsing and/or using NeuXP Group of companies (“NeuXP”) website, or any applications including mobile applications made available by NeuXP, Inc. and/or NeuXP Sdn Bhd (together, the “Platform”), however accessed, you agree to be bound by these terms of use (“Terms of Use”), which may change at any time without prior notice.

Any analysis or transformation of data provided herein are made by NeuXP and shall not be attributed to the respective authorities or its statutory bodies. These Terms of Use affect your legal rights and obligations. If you do not agree to be bound by all of these Terms of Use, do not access or use the Platform.

 

Access to the Platform

Except as otherwise noted in the Platform developed by NeuXP, all content and material on including information, photos, podcasts, blog posts, graphics/charts, icons, code, design and overall appearance are the property of NeuXP (and its affiliates) and should not without our prior written consent; be used, modified or reproduced. All the intellectual property rights, including copyrights, patents, trademarks, and trade secrets in the Platform are owned by NeuXP. Neither these Terms of Use (nor your access to the Platform) transfers to you or any third party any rights, title or interest in or to such intellectual property rights, except for the limited access rights expressly set herein.

 

Subject to these Terms of Use, NeuXP hereby grants you a non-transferable, non-exclusive, revocable, limited license to use, browse and/or access the Platform solely for your own personal, non-commercial use subject to the following restrictions: (a) you shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Platform, whether in whole or in part, or any content displayed on the Platform; (b) you shall not modify, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Platform; and (c) except as expressly stated herein, no part of the Platform may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means.

The Platform is intended for general informational purposes only. All contents in the Platform should not be relied upon as legal or other professional advice or used as a substitute for legal or other professional advice on the particular facts and circumstances at issue. NeuXP makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability or its contents on the Platform for any purpose. NeuXP accepts no responsibility for any loss which may arise from accessing or reliance on information contained on the Platform and hereby expressly disclaims, to the fullest extent permitted by applicable law, any and all liability for any loss or damage arising out of or in connection with the use of the Platform or its contents.

 

Scope of Service

Xplore by NeuXP provides an online platform where you can browse different types of attraction park entrance tickets, experiences and tours, or other services (“Services”). Users are provided access to make bookings of services provided by Vendors on the Platform. By placing an order through the Platform, you will be able to book and/or purchase the event entrance tickets, tourist attraction entrance tickets, experiences and tours, or other services. All orders are presented in the form of a QR code and/or ticket in the Platform in which the user will be required to scan and/ or to download and print a physical copy of the ticket.  There will not be any booking confirmation sent through e-mail. The vendor reserves the right to refuse any form of booking in the event the QR code and/or ticket was not presented at the point of entrance.

 

All pricing and information provided by our vendors are deemed accurate during all times, and NeuXP does not verify, or guarantee, that all information provided by Vendors that is available on the Platform is up-to-date or accurate based on the latest available. We are not held liable for any form of misleading or inaccurate information presented by the Vendors.

 

There may be inaccurate information displayed on the Vendors website due to sudden changes in market conditions or other circumstances within a short time. Please check all details on the Vendors website prior to purchasing your tickets. 

 

NeuXP has the right to refuse any form of bookings or perform a cancellation at our sole discretion for any cause without giving reasons for the rejection/refusal/cancellation.

The reasons for the cancellation or rejection may be due to the below:

1. Breach of Terms of Use

2. Trade or economic sanctions, embargo, prohibitions in regulations, fraud or theft (or indication or suspicion of fraud or theft)

3. Suspicion of criminal activity or suspicious ordering

4. Services not available or no longer made available by the Vendor

5. User providing inaccurate, erroneous or misleading information

6. Issues with credit card electronic communications, information or transactions

7. Refusal of user to provide information, displaying inappropriate behavior, threats, insults, refusal to provide information, practical impediments, communication difficulties or breakdowns, history of breaches of these Terms

8. Placed on any “blacklists” or “watchlists” by government or international organization

 

NeuXP reserves the right to delete or remove the account of any user of the Platform temporarily or permanently at any time. Removed users shall not attempt to use the Platform using other names or through other users. If found, NeuXP can terminate the user's account at any time immediately.

 

Payment

All payments related to the booking or reservation of the Services is made directly to NeuXP through its payment channels. All payments will be the property of NeuXP and the amount will be paid to the relevant Vendor when the services are provided or at any other applicable time required by the relevant Vendor. NeuXP shall not be responsible for the validity of the reservation if the payment is not being made directly to NeuXP through its payment channels. 

 

Cancellation and Refunds (applicable to Xplore by NeuXP)

Upon making a booking, order or reservation through the application, you hereby accept and agree to the terms and services of the Vendors, including policies regarding cancellation and/or absence. NeuXP is not responsible for any violation of these Terms of Use, or which are based on the user’s specific requests, so please read the Vendors’ Terms of Use carefully before you make a booking, order or reservation through the Site.

 

Refunds involving credit card chargeback, and subject to any applicable rights you may have at law, NeuXP may have the right to withhold or take part of the amount paid to reimburse the reasonable costs that have been incurred in connection with the cancellation.

Any cancellations made are to be done within the specific time frame provided, in order for the user to receive a full refund in the form of credits or vouchers. NeuXP has the right not to proceed with any form of refunds for transactions that are canceled after the deadline provided. 

 

Subject to this Terms of Use, NeuXP is providing the services on behalf of the Vendors, as described in further detail on the application. The Services selected by you on the application are solely meant for your own usage, and not for the benefits of any third party. NeuXP may also limit your access to certain Services without any prior notice or liability.

 

NeuXP does not guarantee that the Services will always be available or uninterrupted. NeuXP shall not be held liable in the event that any of the Services are unavailable at any time or for any period. You are required to make all arrangements necessary for you to have complete access to the Services booked. 

 

You are also responsible for ensuring that all other persons who have the access to internet connections are fully aware of the Terms of Use any other applicable Terms of Use and to fully comply with them.

• Subject to this Terms of Use, the Services that have been selected by you on the Platform are solely for your own personal use, and not for the benefit of any third parties. NeuXP may change, suspend or discontinue any Services at any time, including the availability of any feature, database or content. NeuXP may also impose conditions on certain Services or restrict your access to any part or all of the Services without giving prior notice or liability.

• NeuXP does not guarantee that the Services will always be available or uninterrupted. NeuXP will not be liable to you if for any reason the Services are unavailable at any time or for any period. 

 

NeuXP’s Responsibility

You hereby agree that NeuXP is not responsible or liable for any losses or damages incurred as the result of any dealings. If there is a dispute arising between participants on this site, or between users and any third party vendors, you hereby understand and agree that NeuXP is under no obligation to become involved in any form of dispute. 

 

In the event of a dispute with one or more other users or third parties, you hereby release NeuXP, its holding companies, subsidiaries, directors, and employees from any form of claims, demands, and damages of every kind arising in any way related to such disputes.

 

Termination Notice

Due to any reason, without notice, NeuXP reserves the right to terminate or suspend your access to the Services at any time which may result in a forfeiture associated with your access to the Platform. Should there be any form of breach in the Terms of Use, NeuXP has the right to suspend or the user's access to all Services immediately without prior notice or liability.

 

Upon termination of your account, your access to the Platform will immediately cease and you will lose access to all Services and benefits where applicable.

 

If this Terms of Use is terminated as a result of your breach, NeuXP reserves the right to forfeit any outstanding vouchers you may have purchased prior to said termination, without refund or liability to you.

Closure or deletion of account

If you're encountering any issue on the NeuXP platform, you may refer to our customer support team at support@neuxp.com.

 

In the event you wish to close or delete your account you may do so through the platform at any time by following the steps below:

 

• Tap on the Settings button on the top right of the main page

• Select Profile

• Scroll down to Actions and tap Close Account 

 

After taking the steps to close/ delete your account, it will first be deactivated within 2 business days. You will receive a notification from us once your request is successful and you will no longer have access to your account.

 

After an additional 30 days, your account will be permanently deleted. This means that your account, account settings and other data in our main user database will be deleted.

 

We may retain some personal data for certain legal, security, and business needs as per the Terms of Use, Privacy and Cookies Policy which you have accepted at the point of account creation.
